Service Description
Agard Research Associates offers voluntary, confidential mediation services to help parties in conflict reach mutually agreeable resolutions. Our mediator facilitates constructive dialogue in a neutral setting, guiding participants toward collaborative problem-solving. Suitable for community disputes, organizational conflicts, workplace disagreements, academic concerns, and family communication challenges. This is a private mediation service provided outside the court system. Mediation is voluntary, and the mediator does not render decisions or provide legal advice. Parties with active litigation or court-involved matters should consult with court-approved mediators or legal counsel.
Service Policy
AGARD RESEARCH ASSOCIATES INC. — PRIVATE MEDIATION SERVICES POLICY NATURE OF MEDIATION Mediation is a voluntary, confidential process in which a neutral mediator facilitates communication between disputing parties to help them reach a mutually acceptable resolution. The mediator does not act as a judge, attorney, or advocate. The mediator does not make decisions, render judgments, or impose outcomes. ARA mediation services are private and conducted outside the court system. VOLUNTARY PARTICIPATION Participation is entirely voluntary. Any party may withdraw at any time without penalty. The mediator may terminate mediation if continuing would be unproductive or unsafe. CONFIDENTIALITY All communications during mediation are confidential and shall not be disclosed except as required by law or to prevent imminent harm. Parties agree not to subpoena the mediator in any legal proceeding. Mediation communications are not admissible in subsequent proceedings to the extent permitted by law. NO LEGAL ADVICE The mediator does not provide legal, financial, or professional advice. Parties are encouraged to consult independent counsel. Any agreement reached is non-binding unless formalized through appropriate legal channels. SCHEDULING Cancellations must be made at least 1 hour before the session. Rescheduling requests must be made at least 12 hours before and are subject to availability. Repeated no-shows may result in termination of services. LIMITATION OF LIABILITY To the fullest extent permitted by law, ARA, its officers, employees, and volunteers shall not be liable for any damages arising from mediation, including outcomes, party conduct, or agreements reached. For complimentary services, liability is limited to $0.00. HOLD HARMLESS By participating, each party agrees to hold harmless and indemnify ARA from any claims, damages, or expenses arising from the mediation process or any agreement reached. GOOD FAITH Parties agree to participate respectfully, provide accurate information, and make genuine efforts toward resolution. By participating, all parties acknowledge they have read, understood, and agree to this policy.
