This Privacy Policy describes how Agard Research Associates Inc. ("we," "us," or "our") collects, uses, shares, retains, and protects personal data, and what you can require of us. It applies when you:

  • Visit our website at https://www.agardresearchassociates.org or any other site of ours that links to this policy

  • Create an account, subscribe to a newsletter, or use a feature on our website

  • Make a donation

  • Participate in a research study or survey

  • Engage with us in another way, including events, workshops, and professional collaborations

We have written this policy to be read rather than to be defensible. Where a legal obligation is uncertain, we say so rather than implying more coverage than exists. Where we extend a right voluntarily, we say that too, so that you know what you are relying on.

Service providers under contract, and other parties where the law requires it or you have consented. We do not sell personal data. We do not share personal data for cross-context behavioral advertising. We do not rent, trade, or exchange donor lists.

1. WHAT INFORMATION WE COLLECT

 

INFORMATION YOU PROVIDE

 

We collect what you give us when you create an account, subscribe, donate, register for an event, participate in research, ask us for information, or otherwise contact us.

 

Depending on the interaction, this may include:

  • Identifiers and contact details. Name, email address, postal address, telephone number, and social media handle.

  • Account credentials. Username, password, and account preferences.

  • Communication preferences. Subscription choices, opt-ins, and preferred contact method.

  • Donation records. Amount, date, payment method type, and acknowledgment preference. We do not receive or store full payment card numbers.

  • Professional information. Job title, organizational affiliation, and professional interests.

  • Research participation data. Survey responses, interview recordings and transcripts, and other information you supply during a study, collected under informed consent.

  • Content you submit. Comments, posts, and material you send us.

INFORMATION COLLECTED AUTOMATICALLY

 

Some information is collected when you visit, whether or not you give us anything. This does not by itself identify you.

​

  • Log and usage data. IP address, browser type, device information, pages viewed, time spent, links clicked, and the date and time of your visit.

  • Device data. Device type, operating system, unique device identifiers, and mobile network information.

  • Approximate location. Country and city inferred from IP address. We do not collect precise geolocation without your explicit consent.

  • Cookie data. As described in Sections 5 and 6 and in our Cookie Policy.

SENSITIVE DATA

 

We do not intentionally collect sensitive personal data for general website operations. Sensitive data includes racial or ethnic origin, religious or philosophical belief, mental or physical health condition or diagnosis, sex life or sexual orientation, citizenship or immigration status, status as transgender or non-binary, genetic or biometric data processed to identify an individual, precise geolocation, and personal data of a known child.

Where a research study requires sensitive data, we collect it only with your explicit informed consent and only with the safeguards described in Section 9.

2. HOW WE USE IT

​

  • To operate our services. Create and administer accounts, deliver what you asked for, and maintain website functionality.

  • To process donations. Complete transactions, issue receipts and acknowledgments, and maintain the records a nonprofit corporation is required to keep.

  • To communicate. Send newsletters you subscribed to, answer inquiries, and share information about our work and events.

  • To conduct research. With informed consent, carry out academic research and policy analysis and produce scholarly publications.

  • To improve. Understand how the website is used and where it fails.

  • To secure. Detect, prevent, and respond to security incidents, fraud, and abuse.

  • To comply. Meet legal, tax, and nonprofit reporting obligations and respond to lawful requests.

  • To protect. Safeguard the rights, safety, and property of our organization, the people we work with, research participants, and the public.

We do not use personal data for automated decision-making that produces legal or similarly significant effects, and we do not profile individuals for that purpose.

​

3. OUR LAWFUL BASES

 

Where a law requires us to identify a lawful basis, we rely on the following.

​

  • Consent. Newsletter subscription, research participation, non-essential cookies, and any processing of sensitive data. You may withdraw consent at any time, and withdrawal is as easy as giving it.

  • Contract. Processing necessary to provide something you requested, such as an event registration.

  • Legal obligation. Donation and financial records retained for tax purposes, responses to valid legal process, and nonprofit reporting.

  • Legitimate interests. Security, fraud prevention, and service improvement, where those interests are not overridden by your rights and freedoms. We do not rely on legitimate interests as a basis for setting non-essential cookies where consent is required.

  • Vital interests. In rare circumstances, to protect someone's life or physical safety.

  • Public interest and research. Where applicable, processing for archiving, scientific, or historical research purposes, subject to appropriate safeguards.

4. WHEN AND WITH WHOM WE SHARE IT

 

SERVICE PROVIDERS

 

We share personal data with providers who perform functions on our behalf. Each is bound by written contract that identifies the data and the purpose, limits processing to that purpose, prohibits sale and secondary use, requires confidentiality and appropriate safeguards, requires prompt notice of any security incident, addresses subprocessors, and requires deletion or return of the data when the engagement ends.

  • Website hosting and member accounts. Wix

  • Analytics. Google Analytics

  • Donation processing. Wix Donations and Wix Payments, Donorbox, and PayPal

  • Email distribution. Newsletter and email service providers

  • Cloud storage. Secure cloud infrastructure providers

LEGAL REQUIREMENTS

 

We may disclose personal data in response to a subpoena, court order, or other lawful process, or where we reasonably believe disclosure is necessary to protect legal rights, investigate fraud, or address an imminent threat to safety. Where we are permitted to notify you of such a request, we will.

​

ORGANIZATIONAL CHANGES

 

If our organization merges with, is acquired by, or transfers assets to another organization, personal data may be transferred as part of that transaction. We will give notice and describe the choices available to you before any such transfer takes effect.

WITH YOUR CONSENT

 

We share with other parties only where you have given explicit consent.

DONOR PRIVACY

 

We do not sell, rent, trade, or share donor names or personal data with any other entity, and we do not send mailings to our donors on behalf of other organizations. This applies whether or not you have asked us for it, and it is not conditioned on gift size.

​

5. COOKIES AND TRACKING TECHNOLOGIES

 

We use cookies and similar technologies. Non-essential cookies are set only with your consent. Our Cookie Policy sets out each cookie, its purpose, and its duration, and this section is a summary of it.

  • Essential cookies. Necessary for the website to function and for security. These do not require consent.

  • Analytics cookies. Help us understand how the website is used. Set only with consent.

  • Functional cookies. Remember your preferences and settings. Set only with consent.

 

We do not use advertising or marketing cookies. You may change or withdraw your consent at any time through the cookie settings control on the website or your browser settings.

6. GOOGLE ANALYTICS

 

We use Google Analytics 4, a service of Google LLC, to understand how the website is used. It collects a randomly generated client identifier, session data, device and browser information, approximate location at country and city level, and referral source. Google Analytics 4 does not log or store full IP addresses.

​

We have entered a data processing agreement with Google, disabled data sharing for advertising purposes, and limited the retention period. For visitors in the European Economic Area and the United Kingdom, we use Google Consent Mode v2 so that Google Analytics behavior follows your consent choice.

​

You may opt out by declining analytics cookies in our consent banner, by installing the Google Analytics Opt-out Browser Add-on, or by blocking cookies from google-analytics.com in your browser.

7. ACCOUNTS

 

Our website allows you to create an account. When you do, we collect your name, email address, and password, together with any additional profile information you choose to add.

​

You are responsible for keeping your credentials confidential. Please notify us at security@agardresearchassociates.org if you believe your account has been accessed without authorization.

​

You may update your information and preferences at any time in your account settings. You may request deletion of your account at any time by writing to data@agardresearchassociates.org. On receiving your request we delete or anonymize the account, other than information we are required to retain for legal, tax, or security purposes, which we will identify to you.

​

8. DONATIONS

 

When you donate, we collect your name, email address, postal address if you provide it, the amount, and any note or dedication you choose to add, in order to process the gift, acknowledge it, and issue a receipt.

​

HOW DONATIONS ARE COLLECTED

 

We accept donations through three channels. Which one you use determines who handles your payment details and whose privacy terms apply in addition to ours.

​

  • Wix Donations, a donation application provided by our website platform, with payment processed through Wix Payments or another provider connected to it. Checkout takes place on our own site. See the Wix Privacy Policy.

  • Donorbox, a donation form embedded in or launched from our site. See the Donorbox Privacy Policy.

  • PayPal, whether reached directly or used as the payment method behind one of the channels above. See the PayPal Privacy Statement.

 

Each provider operates under its own privacy policy and under our written agreement with it, and each is contractually restricted to processing donor data for the purpose we specify.

WHAT WE DO NOT HOLD

 

We do not receive, store, or have access to your full payment card number, bank account number, or payment credentials. These are transmitted directly to the payment provider and do not reach our systems at any point, including where checkout takes place on our own site.

​

WHAT WE DO HOLD

 

We hold a record of the donation itself. Your name, contact details, gift amount, gift date, and any note you added are retained in our donation records, because a nonprofit corporation is required to keep them. We retain donation records for seven years to meet tax and nonprofit recordkeeping requirements. That period is fixed by law and a deletion request cannot shorten it, though we will delete anything not required to be retained and will tell you what we kept and why.

​

Because we use more than one donation channel, a record of your gift may exist in the dashboard of the provider you used as well as in our own records. A request to us covers our records, and we will instruct the provider to act on your request as well. If you are unsure which channel you used, tell us the date and approximate amount and we will identify it for you.

​

COVERING PROCESSING FEES

 

Some of our donation forms offer you the option to add the payment processing fee to your gift so that we receive closer to the full amount. Choosing it increases the total charged to you above your donation amount. Your receipt shows the amounts separately.

​

RECURRING GIFTS

 

If you set up a recurring gift, your payment credentials are stored by the payment provider, not by us. You may modify or cancel a recurring gift through your account with that provider, through the members area of our website if you created one, or by writing to billing@agardresearchassociates.org. Tell us which channel you used and we will direct you to the right place.

TAX TREATMENT

 

We make no representation as to the tax treatment of any particular gift. Whether a contribution is deductible depends on your circumstances and is a question for your own tax adviser.

​

DONOR PRIVACY

 

We do not sell, rent, trade, or share donor names or personal data with any other entity, and we do not send mailings to our donors on behalf of other organizations. This applies whether or not you ask for it, and it is not conditioned on the size of your gift.

​

9. RESEARCH DATA AND HUMAN SUBJECTS

 

We conduct academic research and policy analysis. If you take part in a study, this section governs how we handle what you tell us.

​

INFORMED CONSENT

 

Before participating, you receive a description of the study's purpose, procedures, foreseeable risks, benefits, retention period, and the identity of the people responsible. Participation is voluntary. You may withdraw at any time without giving a reason and without penalty.

​

COLLECTION

 

We collect only what the research objective requires. Research data may include survey responses, interview recordings and transcripts, demographic information, and other material you supply.

​

SENSITIVE DATA IN RESEARCH

 

Where a study requires sensitive personal data, including political or social opinion, demographic characteristics, or health-related information, we collect it only with explicit consent and with safeguards that include:

  • Institutional Review Board oversight where applicable

  • Data minimization and pseudonymization at the earliest practicable point

  • Storage with access limited to those with a research need

  • Confidentiality protection in any publication

WITHDRAWAL

 

If you withdraw, we stop collecting from you immediately. Data already collected is deleted on request unless it has been anonymized beyond re-identification or its removal would compromise the integrity of an analysis already conducted, in which case we tell you and explain why.

​

RETENTION AND PUBLICATION

 

Research data is retained for the period stated in the consent form for that study, after which it is securely deleted or anonymized. Published findings do not identify individual participants unless you gave explicit, separate consent to be identified.

We do not attempt to re-identify data that has been de-identified or anonymized, and we require the same of anyone to whom we provide such data.

10. INTERNATIONAL TRANSFERS

 

We are located in New Jersey, United States. If you access our services from outside the United States, personal data may be transferred to, stored in, and processed in the United States and in other countries where our providers operate. Privacy laws in those countries may differ from those where you live.

​

  • EU-US Data Privacy Framework. For transfers from the European Economic Area, we rely on the Framework where our provider is certified under it. Google is so certified.

  • UK Extension. For transfers from the United Kingdom, we rely on the UK Extension to the EU-US Data Privacy Framework.

  • Standard Contractual Clauses. Where the Framework does not apply, we use Standard Contractual Clauses approved by the European Commission, together with any supplementary measures the transfer requires.

If you are in the European Economic Area or the United Kingdom, you may request information about the safeguards applied to a transfer by writing to data@agardresearchassociates.org.

​

11. HOW LONG WE KEEP IT

 

We keep personal data only as long as the purpose requires or the law compels, then delete or anonymize it.

​

  • Account information. Duration of the account, plus 30 days after a deletion request. Basis: contract.

  • Newsletter subscriptions. Until you unsubscribe or request deletion. Basis: consent.

  • Donation records. Seven years from the date of the gift. Basis: legal obligation.

  • Tax and financial records. Seven years. Basis: legal obligation.

  • Website analytics. Up to 26 months. Basis: legitimate interests.

  • General inquiries. 30 days after resolution. Basis: legitimate interests.

  • Research data. As stated in the study consent form. Basis: consent.

  • Rights request records. As required to demonstrate compliance. Basis: legal obligation.

  • Records under legal hold. Until the hold is released. Basis: legal obligation.

 

Where immediate deletion is not possible because data sits in a backup archive, we isolate it from further processing and delete it when the archive cycles.

12. HOW WE PROTECT IT

 

We maintain administrative, technical, and physical safeguards proportionate to the volume and sensitivity of the data we hold. These include:​

  • Encryption in transit and, where practicable, at rest

  • Access limited to those with a demonstrated need, reviewed at least annually and revoked promptly on a change of role or departure

  • Unique credentials and multi-factor authentication on email, financial systems, and any system holding sensitive data

  • Timely application of security updates and use of supported software

  • Backups with restoration tested at least annually

  • Secure disposal of records and media

  • Annual training for everyone who handles personal data on our behalf

  • Payment processing through PCI-DSS compliant third parties

No method of transmission or storage is completely secure, and we do not claim otherwise. If you believe your interaction with us is no longer secure, tell us at security@agardresearchassociates.org.

​

IF THERE IS A BREACH

 

If a security incident affects your personal data, we will notify you and the relevant authorities as applicable law requires and within the periods it prescribes. Under New Jersey law we notify the Division of State Police before notifying affected individuals, and we honor any request from law enforcement to delay individual notice while an investigation proceeds. Our notice will describe what happened, what data was involved, what we have done, and what you can do.

13. YOUR RIGHTS

 

Depending on where you live and which law applies, you may have the following rights. Where a right is not owed to you as a matter of law, we generally extend it anyway.

​

  • Access. Confirm whether we process your personal data and obtain a copy.

  • Correction. Have inaccurate or incomplete data corrected.

  • Deletion. Have your personal data deleted, subject to the exceptions in Section 11.

  • Portability. Receive a copy in a structured, commonly used, machine-readable format.

  • Opt out. Opt out of sale, targeted advertising, and profiling with legal or similarly significant effects. We do none of these, so such a request will ordinarily be confirmed rather than acted upon.

  • Withdraw consent. Withdraw consent at any time, without affecting the lawfulness of prior processing.

  • Object or restrict. Object to processing based on legitimate interests, or restrict processing while a dispute is resolved.

  • Non-discrimination. Exercise any of these rights without being denied service, charged differently, or given a lesser experience.

HOW TO EXERCISE THEM

​

​

VERIFICATION AND TIMING

 

We verify your identity by means proportionate to the sensitivity of the data before acting. An opt-out request requires no verification. We acknowledge a request within ten business days and respond within 45 days, extendable once by a further 45 days where reasonably necessary and with notice to you. Under the General Data Protection Regulation the period is one month, extendable by two further months for complex or numerous requests. Opt-out requests are actioned as soon as feasible and no later than 15 days.

APPEALS

 

If we refuse a request, you may appeal within 45 days by writing to data@agardresearchassociates.org with "Appeal" in the subject line. The appeal is decided by someone other than the person who made the original decision, and we respond within 45 days. If we deny the appeal, we will tell you how to contact the relevant supervisory authority.

​

14. NEW JERSEY RESIDENTS

 

The New Jersey Data Privacy Act, N.J.S.A. 56:8-166.4 et seq., took effect on 15 January 2025. Unlike most comparable state statutes, it contains no entity-level exemption for nonprofit organizations.

​

Whether the Act applies to us in a given year depends on volume thresholds, which we monitor and report to our Board at least annually. The Act reaches a controller that, during a calendar year, controls or processes the personal data of at least 100,000 New Jersey consumers, or at least 25,000 New Jersey consumers where the controller derives any revenue or a discount from the sale of personal data. Where we meet a threshold, we comply as the Act requires. Where we do not, we extend the same rights voluntarily, so that your position does not depend on our size.

New Jersey breach notification requirements apply to us without regard to those thresholds, and we comply with them in all cases.

​

YOUR RIGHTS

  • Delete personal data provided by or obtained about you

  • Obtain a portable copy

  • Opt out of targeted advertising, sale of personal data, and profiling in furtherance of decisions producing legal or similarly significant effects

SENSITIVE DATA AND MINORS

 

We do not process sensitive data without your opt-in consent. We do not process the personal data of a known child under 13 without consent obtained in accordance with the Children's Online Privacy Protection Act, and we do not sell the personal data of, or conduct targeted advertising to, a consumer we know to be under 17.

​

UNIVERSAL OPT-OUT

 

We honor universal opt-out mechanisms, including Global Privacy Control, and propagate the signal to our processors.

APPEALS

 

Appeal a refusal within 45 days at data@agardresearchassociates.org. If we deny the appeal, you may submit a complaint to the New Jersey Division of Consumer Affairs, Office of the Attorney General, at njconsumeraffairs.gov.

​

15. CALIFORNIA RESIDENTS

 

The California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to for-profit businesses. As a nonprofit organization we are generally outside its scope. We nonetheless disclose our practices and extend equivalent choices to California residents.

​

In the preceding 12 months we have collected the following categories:

A. Identifiers. Name, email, IP address, account name. Collected: yes.

B. Customer records. Name, postal address, telephone number. Collected: yes.

C. Protected classifications. Age, gender, race, religion. Collected: only in research, with consent.

D. Commercial information. Donation history. Collected: yes.

E. Biometric information. Fingerprints, voiceprints. Collected: no.

F. Internet activity. Browsing and interaction data. Collected: yes.

G. Geolocation data. Approximate location from IP address. Collected: yes.

H. Sensory data. Audio and video recordings. Collected: only in research, with consent.

I. Professional information. Job title, employer. Collected: limited.

J. Education information. Student records. Collected: no.

K. Inferences. Preferences and characteristics. Collected: no.

L. Sensitive personal information. Government identifiers, financial account, health data. Collected: no.

 

We do not sell personal information and we do not share personal information for cross-context behavioral advertising. California Civil Code § 1798.83 permits residents to request information about disclosures to third parties for direct marketing purposes; we make no such disclosures.

16. COLORADO AND OREGON RESIDENTS

 

The Colorado Privacy Act, effective 1 July 2023, and the Oregon Consumer Privacy Act, which extended to nonprofit organizations on 1 July 2025, reach nonprofits that meet their applicability thresholds.

​

Residents of both states have rights of access, correction, deletion, and portability, and rights to opt out of targeted advertising, sale, and profiling in furtherance of decisions with legal or similarly significant effects. Colorado residents may appeal a refusal and, if the appeal is denied, contact the Colorado Attorney General. Oregon residents may contact the Oregon Attorney General.

17. EUROPEAN ECONOMIC AREA, UNITED KINGDOM, AND SWITZERLAND

 

The General Data Protection Regulation and its United Kingdom and Swiss equivalents may apply to us where we offer goods or services to individuals in those territories or monitor their behavior, including through research participation or subscription services. Incidental readership of a public website by a person abroad does not by itself bring us within scope. We assess applicability at least annually.

Where the Regulation applies to our processing, we comply with it, and you have the following rights:

  • Access your personal data and receive a copy

  • Rectify inaccurate or incomplete data

  • Erase your personal data

  • Restrict processing

  • Data portability

  • Object to processing based on legitimate interests, and to direct marketing at any time

  • Withdraw consent at any time

  • Not be subject to a decision based solely on automated processing that produces legal or similarly significant effects

  • Lodge a complaint with a supervisory authority

SUPERVISORY AUTHORITIES

 

You may complain to the supervisory authority of your habitual residence, place of work, or the place of the alleged infringement. In the United Kingdom this is the Information Commissioner's Office. In Switzerland it is the Federal Data Protection and Information Commissioner.

PRIVACY OFFICER

 

Privacy compliance is administered by our Privacy Officer, a position appointed by the Board of Directors under our Bylaws. Where the Regulation applies and the conditions requiring designation of a statutory data protection officer are met, the Board designates one and observes the statutory conditions of independence and reporting. Where those conditions are not met, the role is that of Privacy Officer, and we do not describe it as a statutory data protection officer.

AUSTRALIA AND NEW ZEALAND

 

We handle personal information consistently with Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020. You may access and correct your personal information. Complaints may be made to the Office of the Australian Information Commissioner or the New Zealand Office of the Privacy Commissioner.

CANADA

 

We handle personal information consistently with the Personal Information Protection and Electronic Documents Act and applicable provincial legislation, including Quebec's Law 25. You may access and correct your personal information and withdraw consent.

SOUTH AFRICA

 

We handle personal information consistently with the Protection of Personal Information Act. You may access, correct, and delete your personal information, and may contact the Information Regulator at enquiries@inforegulator.org.za.

ELSEWHERE

 

If you are somewhere not named above and have a question about your rights, write to data@agardresearchassociates.org. We will tell you what we hold and what we can do about it.

19. DO NOT TRACK AND GLOBAL PRIVACY CONTROL

 

We honor the Global Privacy Control signal. If your browser or device transmits it, we treat it as a valid request to opt out of any sale or sharing of personal data and of targeted advertising, and to limit the use of sensitive personal data. You need not contact us or verify your identity to use it. More information is at globalprivacycontrol.org.

There is no uniform technical standard for Do Not Track signals, and we therefore do not respond to them. If such a standard is adopted that applies to us, we will update this policy.

20. CHILDREN

 

Our services are intended for a general audience and are not directed to children under 13, and we do not knowingly collect personal data from them.

 

Consistent with the Children's Online Privacy Protection Act, if we learn that we have collected personal data from a child under 13 without verifiable parental consent, we delete it promptly. A parent or guardian who believes their child has given us personal data should write to data@agardresearchassociates.org and we will act on it.

 

For minors aged 13 to 16, some state laws require opt-in consent for particular processing. We comply where those laws apply. We do not sell the personal data of, or direct targeted advertising to, any person we know to be under 17.

 

We have no mechanism to verify the age of website visitors and do not attempt to infer it.

We may update this policy to reflect changes in our practices, in the technologies we use, or in applicable law. When we do, we will revise the Effective Date, post the revised policy, and, for material changes, give prominent notice on the website or notify you directly.

Where a change would broaden how we use personal data collected under a previous version, we will seek your consent rather than rely on consent given to the earlier version.

This policy is reviewed at least annually and upon any material change in practice. Previous versions are available on request.
