New Publication: Documentary Proof of Citizenship and Voter Identification in Federal Elections

Agard, titled Documentary Proof of Citizenship and Voter Identification in Federal Elections: A Policy Analysis of the SAVE America Act, Related Executive Actions, Judicial Rulings, and Implications for New Jersey Voters. What the report asks

The report is organized around four questions a New Jersey reader is most likely to bring to the subject: (1) what the federal proposals actually contain, provision by provision, (2) what their current legal status is after the recent congressional votes and court rulings, (3) who would be affected if the requirements took effect, and how, and (4) what New Jersey law requires today. The analysis rests on the official texts of the legislation and executive orders, read directly rather than through secondary characterizations, on the courts' own opinions, and on named national surveys and administrative sources for every empirical claim.

Nothing new is in effect for this November (2026)

The central finding is a matter of legal status rather than prediction. As of July 5, 2026, no new federal requirement for documentary proof of citizenship and no new federal photo identification requirement is in force for the November 3, 2026 midterm elections. The SAVE America Act passed the House on February 11, 2026 but has repeatedly failed in the Senate, most recently by a 48 to 50 vote on June 4, 2026. Two presidential executive orders that sought to impose similar measures by administrative direction have had their central provisions blocked by federal courts, and New Jersey was a plaintiff in the case whose June 25, 2026 ruling expressly covers this November's election. New Jersey voters will register and vote under the same rules as before.

Who the requirements would reach, and why

To identify who would be affected, the analysis works mechanically rather than politically: it asks which documents each pathway requires and which populations hold those documents in a form matching their current legal name. Almost every qualifying document traces back to a passport, which shows a person's current legal name, or a birth record, which permanently shows the name given at birth and is never amended for marriage or divorce. Anyone whose name has changed since birth and who does not hold a passport must connect the old name to the new one with certified paperwork. That design places the heaviest documentary burden on married and divorced women, transgender citizens, naturalized citizens, older Black Americans born where birth certificates were not always issued, and students, drawing on figures from the Pew Research Center, the Brennan Center for Justice, and the U.S. Transgender Survey.

Both sides, on equal terms

Consistent with ARA's nonpartisan mandate, the report presents the case for and against on equal footing. Supporters hold that only citizens should vote in federal elections, that documentary proof and verification systems deter violations and restore public confidence, and that polls in 2024 found large majorities favoring proof of citizenship for new registrants. The measured record shows that noncitizen voting, already a federal crime punishable by prison and deportation, is rare, while similar state laws have turned away eligible citizens, including more than 31,000 blocked in Kansas before courts struck that law down and eligible voters documented as turned away in New Hampshire. The report states both sets of facts and lets readers weigh them.
